Terms and Conditions
1. Scope
All business relations between SEYA Studio, owner Stéphanie Felder (hereinafter "Seller") and the customer (hereinafter "Customer") for purchases made via the SEYA Studio online shop are exclusively subject to the following General Terms and Conditions (GTC) in their version valid at the time of the order.
A customer is defined as any natural or legal person who maintains business relations with the Seller. The offer is aimed at customers residing or having their registered office in Switzerland (and the Principality of Liechtenstein).
2. Conclusion of Contract
The presentation of products in the online shop does not constitute a legally binding offer, but an non-binding online catalogue.
By clicking the order button, the customer places a binding order for the goods contained in the shopping cart. The automatic order confirmation sent immediately afterwards by e-mail merely documents the receipt of the order by the Seller, but does not yet constitute acceptance of the offer.
A purchase contract is only legally concluded when the Seller confirms the dispatch of the goods by e-mail (shipping confirmation) or physically dispatches the goods to the customer. The Seller reserves the right to refuse orders without stating reasons (e.g., due to insufficient availability of goods or pricing errors).
3. Prices and Payment Terms
All prices in the online shop are given in Swiss Francs (CHF).
Since SEYA Studio is currently not subject to value-added tax as a small business, no value-added tax (VAT) is shown, in accordance with legal provisions. Prices are exclusive of shipping costs, unless otherwise stated.
The customer has access to the payment methods offered during the order process. The Seller reserves the right to exclude individual payment methods without stating reasons. The corresponding account will be charged upon completion of the order.
4. Delivery and Shipping
For details on shipping costs, delivery times, and transport conditions, the provisions on the separate page "Delivery & Returns" apply. These provisions form an integral part of these GTC.
Should the delivery of the goods fail due to the customer's fault despite multiple delivery attempts, the Seller may withdraw from the contract. Any payments made will be refunded, whereby incurred shipping and handling costs may be deducted.
5. Right of Return and Withdrawal
In Switzerland, there is no statutory right of withdrawal for online commerce. However, SEYA Studio grants customers a contractual right of return in accordance with the provisions on the separate page "Delivery & Returns". These provisions form an integral part of these GTC.
6. Retention of Title
The delivered goods remain the property of SEYA Studio until full payment of all claims. The Seller is entitled to make an corresponding entry in the retention of title register.
7. Warranty (Liability for Defects) and Disclaimer
7.1 Obligation to Inspect and Notification of Defects
The customer is obliged to inspect the delivered goods immediately upon receipt for completeness and obvious defects. Any defects or incorrect deliveries must be reported to the Seller in writing (by e-mail with a photo of the defect) within 3 working days of receipt of the goods. Otherwise, the goods shall be deemed approved. Hidden defects must be reported immediately upon their discovery.
7.2 Scope of Warranty
In the event of justified defects, the Seller shall decide whether to provide a free repair, an equivalent replacement (replacement delivery), or a refund of the purchase price (cancellation). Further claims are excluded.
7.3 Specific Disclaimer for Materials
- Natural Variations: Genuine freshwater pearls are natural products. Minor deviations in shape, color, size, and surface structure do not constitute a defect, but emphasize the uniqueness of the product.
- Improper Handling: The warranty expires in the event of damage caused by improper handling, lack of care, accidents, or natural wear and tear. Explicit reference is made to the provided "Care Instructions". Damage caused by contact with water, perfumes, cosmetics, sweat (during sports), or mechanical stress is excluded from the warranty.
8. Data Protection
The collection and processing of customers' personal data by the Seller are regulated in the separate Privacy Policy. This can be viewed at any time on the website. The customer agrees to the storage and use of their data as described therein in the course of business transactions.
9. Final Provisions
9.1 Changes to the GTC
The Seller reserves the right to change these GTC at any time. The version of the GTC accepted by the customer at the time of the order shall apply.
9.2 Severability Clause
Should individual provisions of these GTC be or become invalid or incomplete, the validity of the remaining provisions shall not be affected. A legally permissible provision that comes closest to the economic purpose of the invalid provision shall be deemed agreed upon in place of the invalid provision.
9.3 Applicable Law and Jurisdiction
All contracts and legal relations between the Seller and the customer are exclusively governed by Swiss law, to the exclusion of the UN Convention on Contracts for the International Sale of Goods (CISG).
Unless mandatory legal provisions (e.g., consumer protection law) prevail, the Seller's registered office is the exclusive place of jurisdiction for all disputes arising from or in connection with these GTC or the underlying purchase agreement.
